الثورة بتاعتنا ومصر كلها داخلة على كارثة ممكن ترجع البلد سنين وسنين ورا، لما إللى يحط دستور مصر الجديد ناس يختارهم  الحزب الوطنى والإخوان المسلمين، أما الشعب اللى قام بالثورة مايكونش ليه أى رأى فى الموضوع نبقى داخلين على مصيبة. التعديلات الدستورية الجديدة والجدول الزمنى المقترح من المجلس الأعلى للقوات المسلحة يوصلنا لكده، طب إزاى؟

الموضوع ببساطة إن التعديلات الدستورية بتقول إن مجلس الشعب والشورى الجداد هيختاروا 100 واحد يعملوا الدستور الجديد (مادة 189 مكرر) والجدول الزمنى المقترح عايز يعمل انتخابات مجلس الشعب والشورى فى شهر سته (يونيو)، يعنى بعد أربع شهور، وبعد كده يعمل انتخابات الرئاسة فى شهر تمانيه (أغسطس). طيب مين فى خلال 4 شهور يقدر ينظم نفسه ويجمع ناس عشان ينجح فى الانتخابات؟ مفيش غير الحزب الوطنى والإخوان، أما باقى الشعب اللى عمل الثورة وقدم دمه فدا مصر مش هيلحق ينظم نفسه ويعمل أحزاب جديدة ويلاقى الناس المحترمة الشريفة اللى يرشحهم فى الانتخابات، أربع شهور مش كفاية أبداً بعد 30 سنة منغير أى نوع من الديمقراطية. وبعد كل اللى عمله الشعب المصرى كله، ييجى بتوع الحزب الوطنى (الفاسدين) والإخوان (اللى هما مايمثلوش 10% بس من الشعب) يكسبوا ويكتبوا دستور المصريين كلهم؟ طب مش دى تبقى كارثة؟ يعنى نخلص من دستور مرقع ندخل فى دستور متفصل للفساد من بتوع الوطنى ومفيهوش حريات وكله تشدد بسبب الإخوان؟ واحنا اللى شقينا أيام فى الشارع ودفعنا بدمنا ثمن حريتنا مايكونش لينا حتى رأى؟

طب الحل إيه بقى؟ يعنى المجلس يعمل إيه عشان الموضوع يمشى صح؟ فى آراء كتير، مثلاً نعمل فى شهر تمانية الانتخابات الرئاسية، نختار رئيس محترم يكون المصريين كلهم هما اللى مختارينه، يعمل الرئيس لجنة من ناس محترمين يمثلوا شعب مصر كله يعملوا دستور جديد يليق بشعب مصر العظيم اللى أبهر العالم بثورته المتحضرة، وطبعاً الدستور ده هيكون بينظم طريقة الانتخابات بطريقة تخلى كل شعب مصر يكون فى حد بيمثله فى المجلس وبيسمح للناس تعمل أحزاب بحريه، وندى الأحزاب الجديدة سنة مثلاً عشان تلحق تنظم نفسها كويس وتعمل برامج كويسه تفيد الشعب والاقتصاد، ساعتها يقدر يلاقى الشعب المصرى إختيارات محترمة يقدر يثق فيها ويختار منها لمجلس الشعب الجديد. والمجلس الجديد بقى يعمل قوانين متزنة وتحافظ على حرية الشعب المصرى وعلى مصالحه وتحارب الفساد، ويكون مجلس قوى يقدر يراقب الحكومة، مش مجلس زى بتاع سرور (موافقه، موافقة) والسلام. طبعاً التعديلات الدستورية المقترحة دى فيها مشاكل تانية كتير جداً لكن مش مكانها هنا، هكتب عنها فى صفحة تانية


إن التعديلات الدستورية المقترحة والجدول الزمنى سوف يكون لهما آثار قد تطيح بجميع مكاسب الثورة حتى الآن وتعود بنا للوراء وترسخ النظام الفاسد الذى كدنا نطيح به، فطبقاً لما جاء بهما سوف نجد أن من يضع دستور مصر الجديد هم مجموعة يقوم باختيارها عناصر من الحزب الوطنى الديمقراطى والإخوان المسلمين، ولهذا تفصيل

فالتعديلات الدستورية – وبها مشاكل كثيرة لا يتسع لها الحديث هنا – تقضى بأن ينتخب مجلسا الشعب والشورى 100 شخص للقيام بوضع دستور جديد للبلاد، إذا يجب أن يكون الشعب المصرى ممثلاً تمثبلاً حقيقياً فى المجلسين حتى يكون اختيارهما للمائة شخص ممثلاً للشعب فيخرج الدستور المصرى الجديد ممثلاً لهذا الشعب

وبغض النظر عن كون تلك الطريقة المقترحة هى الأفضل أم لا، فالمشكلة الحقيقية تكمن فى أن المجلس الأعلى للقوات المسلحة يريد إجراء انتخابات مجلسى الشعب والشورى فى شهر يونيو أى بعد أربعة أشهر من الآن وانتخابات الرئاسة فى أغسطس القادم، وتبريره فى ذلك هو أن الدستور يقضى بأن يحلف الرئيس المنتخب القسم أمام مجلسى الشعب والشورى
إن الشعب المصرى وبعد عقود طويلة من غياب الديمقراطية مطلوب منه أن يختار من يقوم على وضع دستوره الجديد فى أربعة أشهر وهذا غير منطقى أو عملى، فالشعب الذى خرج لصنع ثورة أبهرت العالم أغلبه غير منتم لتيار أو فكر سياسى أو حتى لديه اهتمام بالسياسة لأنه لم يكن عنده اختيارات حقيقية بين احزاب واقعية وعاملة لها حضور فى الشارع، كما أن أربعة أشهر لا تكفى لعمل أحزاب جديدة تستطيع بلورة اتجاه سياسى وبرنامج حزبى يستطيع أن يمثل هذا الشعب بكامل طوائفه، وواقعياً فإن حرية تأليف الأحزاب غير موجودة أو قانونية حتى الآن. يبقى إذا لهذا الشعب اختيارات ثلاث فى الانتخابات وهى إما فلول الحزب الوطنى الذى مازال له قاعدة شعبية وتنظيم لا يستهان به، أو الإخوان المسلمين المنظمين جدياً ولهم خبرة كبيرة فى الانتخابات أو مستقلين جدد ليس لهم برامج حقيقية تستطيع أن تقنع الشارع المصرى، بالإضافة إلى الأحزاب الموجودة حاليا والتى ليس لها أى وجود أو إحساس بالشارع. وإن افترضنا أننا نستطيع فى أربعة أشهر أن نحشد جماهير الشعب سياسياً لحثه على النزول لصناديق الاقتراع – وهذا غير واقعى – فإن اختياراته – كما أسلفنا الذكر – لا تعبر عن غالبيته، وتكون النتيجة أن يتم انتخاب مجلس غالبيته العظمى من فلول الحزب الوطنى المتلونين والإخوان المسلمين، وإن صرفنا النظر عن أنه سيكون مجلس من الفاسدين (حزب وطنى) أو متشددين (إخوان) فإننا لا نستطيع أن نتجاهل كونه غير معبر فعلياً عن الغالبية العظمى من الشعب المصرى. فكيف يتم وضع دستور مصر بعد الثورة من قبل هؤلاء؟! أن هذا ضرب للديمقراطية والحرية التى ناضلنا فى ثورتنا من أجلهما، إن هذا قتل عملى للثورة ولن تستطيع مصر تدارك والتغلب على تأثيره الكارثى لعقود طويلة، فالدساتير لا تتغير كل عام والثورات لا تتفجر كل جيل

هناك سيناريوهات مطروحة تكفل عدم حدوث مثل تلك الكارثة ارى أن افضلها هو
أ- تعديل مواد الدستور بحيث يقوم الرئيس بحلف القسم أمام الشعب، فنستطيع انتخاب الرئيس قبل انتخاب مجلس الشعب
ب- وضع مادة فى الدستور تقضى بأن يشكل الرئيس لجنة تأسيسية لوضع دستور جديد يطرح مبدئياً للحوار المجتمعى ثم للاستفتاء فى فترة لا تزيد عن 6 أشهر وأن يكون هذا الدستور لجمهورية برلمانية أو برلمانية/رئاسية  وليس رئاسية كما هو الوضع الحالى
ج- يتم الاستفتاء على مواد الدستور الجديد وليس على الدستور بالكامل لضمان عدم تمرير مواد لا يرضى بها الشعب
د- إطلاق حرية تكوين الأحزاب فوراً
هـ- إجراء انتخابات مجلس الشعب بعد سنة من تولى الرئيس للحكم حتى يكون هناك بعض الوقت لإنشاء أحزاب جديدة ذات برامج تم التفكير فيها جيداً يستطيع على أساسها أن يختار الشعب ممثليه الحقيقيين، ويكون النظام الانتخابى قائم على القائمة النسبية وليس على مقاعد فردية كما هو الآن، فإذا حصل حزب مثلاً على 10% من مجمل الأصوات فيكون له 10% من إجمالى عدد مقاعد البرلمان فيكون اختيار الشعب على أساس سياسات وليس أشخاص
و- يقوم الرئيس الجديد بتكليف وزارة من التكنوقراط الشرفاء مع بداية رئاسته يكون تكليفها تحسين الأوضاع الاقتصادية وتطهير الوزارات من الفساد ومحاربته، على أنت تحل الوزارة تلقائياً بعد انتخابات مجلس الشعب ويتم تشكيل وزارة جديدة بحسب ما ينص الدستور الجديد

ختاماً، يجب على كل مصرى عدم السماح بحدوث هذا السيناريو القائم على الجدول الزمنى المقترح ومحاولة ألا يتم الاستفتاء على تعديلات الدستور كما هى الآن لأن فى ذلك خطر كبير على كل ما اكتسبناه. إن الشعب المصرى جاهد من 1919 وحتى 1923 فى ثورته حتى استطاع أن يرغم النظام على وضع دستور، أما نحن الآن فمطلوب منا أن نصبر ونجاهد ونتمسك بمطالبنا لبضعة أشهر فقط نستطيع بعدها أن نبدأ حياة ديموقراطية على أسس صحيحة تسمح لنا بالمضى فى طريق الإصلاح ويكفل لنا الحرية والكرامة والعدالة الاجتماعية


The proposed constitutional amendments and Schedule proposed by Armed Forces Supreme Council can lead to a grave situation which can set back democracy in Egypt for years to come as it will lead to a new constitution made according to corrupt National Democratic Party and hard line, right wing Muslim Brothers while leave the majority of the population who went out and revolted for their freedoms with no say on the matter.

Although this sounds harsh but can easily be explained. The amendments – putting aside all its other problems – in article 189 gives the newly elected Parliament the responsibility of choosing a committee of 100 people to write the new constitution; in such case the Parliament should reflect a real representation to the Egyptian people so that those chosen 100 reflect the whole spectrum of the Egyptian people in order to produce a realistic Egyptian Constitution.

And whether this way of making the constitution is correct or not, the real problem here is in the schedule the supreme council wants to follow where the Parliamentary elections would take place in June (only 4 month from now) and the Presidential elections would follow in August. Their argument is that the President must take the oath in front of the Parliament as per the constitution.

After decades of absence of all forms of democracy and after decades of Egyptians abandoning political participation, Egyptians are required to democratically elect representatives that would overlook making the nations constitution within four month! it’s neither logic nor realistic to say the least. The only choices the Egyptians will have in four month would be the candidates of National Democratic Party which – although tremendously corrupt – is still organized and with roots in the streets or the well organized, well equipped, longing for the chance Muslim Brothers.

Even if all those concerned about the future of the country put all their efforts and their time into getting the people who never voted to vote and manage to – which again is not realistic – there won’t be any real good choices. Four month is not enough for those who made the revolution to organize themselves, start political parties with well thought programs that the people can vote for; actually freely forming political parties at the moment is not even legal, it’s not an option. This leaves Egyptians with the choices of former NDP members wearing new hats or Muslim Brothers and some others either independent or from an old political party that does not have any credit with the people. The end result is a Parliament dominated by NDP (corrupt) or Muslim Brothers (hard line right wing) and if one can ignore the corruption and the religious extremism one can’t ignore the fact that this Parliament does not actually represent the whole spectrum of the Egyptian society, how can this Parliament oversee the making of a new constitution for Egypt after its revolution?! It’s a hard hit to democracy and liberties we went out to the streets and fought for, it’s a practical end to the revolution and all its gains that cannot be recovered for decades to come as Constitutions are not made every year and revolutions don’t take place but once in a life time, if that.

The scenario that I think is best at dodging this catastrophe is as follows
1- Amend the constitution so that the President can take the Oath in front of the people, this way we can elect a president without electing a Parliament first.
2- Adding an Article that obliges the President to form a founding committee to make a new constitution that first be discussed socially / publicly and then put to a referendum in a period not longer than 6 month. The new constitution must be geared towards a Parliamentary republic or a Parliamentary / Presidential republic but surely not a Presidential one as it is now.
3- Referendum is done on every article and not on the constitution as a whole so as to limit passing articles that the people do not agree to.
4- Immediately giving the right to form political parties without by only informing authorities and not waiting for a permission.
5- Conducting the parliamentary elections a year after the new president is elected to allow some time for new political parties to be established with well thought programs so people can elect their real representatives. Elections should also be with lists not per seats, so that a political party that receives 10% of the total number of votes gets 10% of the Parliament seats. This will make people’s choice more based on policies than people.
6-  Once assuming power, the newly elected president should appoint a cabinet of honorable technocrats with a mission to develop the economy and fighting corruption. This cabinet is automatically resolved once a Parliament is elected and a new cabinet is formed as per the new constitution.

Every Egyptian must not allow the currently allowed scenario to take place, we must stop it at all costs since it can destroy all our gains so far. In the last century, Egyptians fought for years between 1919 and 1923 to reach their goals of having a constitution, today all we need is to have patience and determination for a few month after which we can be on the right track for a democratic free country that guarantee liberties and social justice.

  1. First of all, thank you very much for providing an English translation, it really helps. Second, and most important of all, thank you for that great article, it is a really interesting read.

    I just have a question re your bullet point 2: if you elect a president now, who would that be? And, how can you make sure that he’s not corrupt or following his own agenda (ok, now we can discuss which politician does not do that, but I hope you know what I mean)? It’s just this thing about him putting together the committee working on the constitution that bothers me: if he’s elected, he might as well let his buddies join the committee that works on the constitution and then you’ll never know if they are really making sure that the whole people will benefit from it? And even if you are allowed to vote on the constitution, wouldn’t that be a “yes/no” vote? What about asking the presidential candidates to provide a list of those he (as I guess it will be a he) suggests? Plus short CVs? So that you can make sure that when he gets into power, the whole population (i.e. “lower” social classes, women) will have their say? Or wouldn’t it be best to have some sort of directly elected or even independent committee that will work WITH the president but not under him? To make sure that this is in the interest of people, but not following someones agenda?

    I am asking this because what would you do if someone linked to the MB became president. A fine constitution it would be. However, the constitution is vital, as you write, so you want the best possible.

    Would be interesting to hear your view on this point, and what is being done to avoid a negative szenario! Thanks!

    1. You have legitimate concerns, and you propose good solution like having the list of people he would appoint. Independent one is not an option, who would choose them? Elections again? we run into the same problem. In point 3 I say that referendum be done on every article, it’s difficult but it’s essential at this stage of the Egyptian history. Finally MB will not go for presidency, they will support one candidate but it won’t be one of them.

  2. support of one candidate, and all of a sudden the constitution will be written by the brothers……not good. I don’t have a solution, but there were several suggestions that there would be a committee of 10 wise men who would speak to the army or whatever it was. What if they were assigned by the president to come up with a committee of 100? With a certain quota of farmers and workers representatives and in an ideal case, 50% women to really cover the whole people? The committee of 10 could be voted for – or they are put up by representatives of the revolution with the army or whatever.

    I know this is like “build your ideal state” and might not be a possibility in real life, but then you have the chance to kind of build your ideal Egypt (if they let you) which you are going for anyway, so forgive me if I might come across as slightly dreamy and naive :D.
